High Performance Tutoring, LLC

1. Acceptance of Terms
Welcome to High Performance Tutoring, LLC (“we,” “us,” “our”). By accessing our website, creating an account, or using our tutoring services—whether online or in person—you agree to these Terms & Conditions (“Terms”). If you do not agree, you may not use our services.
These Terms apply to all clients, parents/guardians, students, and website users.
2. Company Information
High Performance Tutoring, LLC operates in multiple regions within the United States. For legal and administrative purposes, our primary business address is: 66 Exchange Place #50, Salt Lake City, UT 84111.
Regional clients may receive support from local teams, but all contractual relationships are with High Performance Tutoring, LLC.
3. Description of Services
We provide:
- - One-on-one academic tutoring (in-person and online via Zoom)
- - Academic coaching and study support
- - Test Preparation (SAT, ACT, PSAT, AP exams, etc.)
- - Homework help, exam preparation, academic skill building
We strive to match clients with highly qualified tutors and to provide an exceptional educational experience.
4. No Guaranteed Academic Outcomes
We do NOT guarantee specific academic results, including but not limited to:
- - Higher grades
- - Admission to a particular school or program
- - Increased SAT, ACT, or PSAT scores
- - Passing of any exam
Academic progress depends on many factors, including the student’s effort, attendance, engagement, and completion of recommended practice. While most of our students experience substantial improvement,
we cannot promise outcomes, and no employee or tutor is authorized to make guarantees.
5. Payment, Billing, and Refund Policies
We offer flexible billing options, including paying per session or purchasing prepaid blocks of tutoring time. All clients receive the first hour of tutoring for free. After that, clients may pay per session or purchase prepaid packages, including SAT/ACT packages of 12, 24, or 48 hours.
5.1 Payment Structure
- - Clients may pay per session after the first free hour.
- - Clients may purchase prepaid packages of tutoring hours.
- - There are no registration or enrollment fees.
5.2 Prepaid Packages
Prepaid hours
never expire. We will honor unused prepaid hours at the original purchase rate for the lifetime of the company, even if our prices increase in the future.
5.3 Cancellation Policy
We require at least
6 hours’ notice to cancel or reschedule a tutoring session.
- - Cancellations made 6 or more hours before the session: No charge.
- - Cancellations made less than 6 hours before the session: Full session charge applies.
- - No-shows and late arrivals that shorten the session are billed for the full scheduled time.
5.4 Tutor Cancellations
If a tutor cancels within the 6-hour window or if there is significant misconduct or negligence, the client will receive a refund, credit, or the charge will be removed. It is at our discretion to determine what constitutes misconduct or negligence.
5.5 Payment Methods
We accept secure payment through Square, PayPal, Venmo, Zelle, and major credit/debit cards. Additional payment methods may be introduced in the future.
6. Scheduling and Session Policies
6.1 Minimum Session Length
All tutoring sessions are billed for a minimum of one hour.
6.2 Tutor Conduct and Safety
Tutors may end a session early if they experience gross misconduct, harassment, unsafe environments, or situations that cause extreme discomfort. Clients may still be billed for the scheduled time if the tutor's actions were reasonable.
6.3 Academic Integrity
Tutors may help with homework, test preparation, projects, and study strategies, but they may NOT:
- - Take exams on behalf of students.
- - Assist with real-time exams.
- - Complete graded assignments intended to be submitted as the student’s own work.
Violations may result in immediate termination of services.
7. Policies for Minors
We frequently work with students under 18, and additional rules apply:
- - Only a parent or legal guardian may create an account or enter a financial agreement.
- - The parent/guardian is the legal customer and is responsible for all payments.
- - Minors may communicate with us and schedule sessions after the parent account is created.
- - For in-home sessions, an adult must be present in the home at all times.
This requirement does not apply to online sessions or sessions held in public spaces such as libraries or coffee shops.
Failure to follow these requirements may result in cancellation of services.
8. User Responsibilities
Clients and students agree to:
- - Provide accurate information when creating accounts or scheduling sessions.
- - Treat tutors and staff with courtesy and professionalism.
- - Use tutoring services in compliance with academic integrity standards.
- - Not misuse our website, scheduling systems, or communication tools.
We may suspend or terminate services for abusive behavior, fraud, academic dishonesty, or violation of these Terms.
9. Communications Consent
By using our services, you consent to receive communications from us, including:
- - Email reminders and updates
- - SMS/text confirmations and notifications
- - Phone calls from our staff
- - Automated scheduling messages
You may opt out of promotional messages at any time. However, operational messages (e.g., billing, scheduling, cancellations) may still be necessary for service delivery.
10. Intellectual Property
All website content—including text, graphics, images, branding, structure, and educational materials—is the property of High Performance Tutoring, LLC. Users may not copy, reproduce, distribute, or modify site content without written permission.
11. Use of Third-Party Services
Our operations depend on third-party platforms such as:
- - Square (payment processing)
- - PayPal (payment processing
- - Venmo (payment processing)
- - Zelle (payment processing)
- - MailChimp (email distribution)
- - Twilio (text messaging and calling)
- - Godaddy (web hosting)
- - Google Analytics
- - Zoom or other video-conferencing tools
These services maintain their own terms and privacy policies. By using our site and services, you agree to comply with these third-party policies as well.
12. Termination of Services
We reserve the right to suspend or terminate services at our discretion, including for:
- - Nonpayment
- - Unsafe, hostile, or inappropriate behavior
- - Academic dishonesty
- - Violations of these Terms
Clients may discontinue services at any time but remain responsible for outstanding balances.
13. Disclaimer and Limitation of Liability
To the fullest extent permitted by law:
- - We are not liable for indirect, incidental, or consequential damages.
- - We are not responsible for academic outcomes, financial losses, or scheduling disruptions.
- - We are not liable for errors, outages, or issues arising from our website or any third-party service providers.
Your use of our services is at your own discretion and risk.
14. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any disputes shall be handled through the appropriate courts in Utah unless otherwise required by local consumer-protection laws.
15. Changes to These Terms
We may update these Terms periodically. The “Effective Date” at the top of the page indicates when the Terms were last updated. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
